Scope of Application
These Terms and Conditions govern the access and use of the portal ducati.audes.com by professional users and duly registered clubs. Access is subject to approval by the portal administrator.Registration and Account
To place orders, registration is required. The request will be verified, and the account will be activated only after confirmation of business details (e.g., VAT number, customer code, etc.). Each user is responsible for keeping their login credentials confidential.Prices and Availability
Displayed prices are reserved for the B2B channel and include VAT. Product availability is indicative and may change without notice.Orders
Orders placed through the portal are binding. Once confirmed, the order cannot be modified without written approval. The seller reserves the right to reject orders in case of availability issues or discrepancies in the provided information.Payments
The available payment methods are indicated on the portal at checkout. Any exceptions must be agreed upon in writing.
VAT Billing Notice
If the issuance of an invoice is requested at the time of purchase, the issuing company reserves the right to verify the validity of the VAT number through the VIES portal (VAT Information Exchange System).
If the company is properly registered with VIES, it may benefit from VAT exemption under the applicable law, and the invoice will be issued without charging VAT.
Please note that the invoice request must be made before the order is completed and, in any case, before the payment is made. Otherwise, it will not be possible to refund the VAT.Shipping
6.1 Processing Times
Orders are typically processed within 30 working days from confirmation, unless otherwise communicated or if products are unavailable. In case of delays, the customer will be promptly informed.
6.2 Shipping Methods
Goods are shipped via selected express couriers. Once the order has been processed, the customer will receive a tracking code to monitor the shipment.
6.3 International Shipments
We ship internationally within Europe and to non-EU countries.
Delivery times vary depending on the destination and may be delayed due to customs checks.
For shipments to non-EU countries, any customs duties, local taxes, or clearance fees are the responsibility of the recipient.
The customer is responsible for the accuracy of the delivery data and for ensuring customs compliance, where required.
Delivery costs and estimated times will be visible during the ordering process. The risk transfers to the buyer upon delivery to the courier.- Claims and Returns
7.1 Claims Deadline
Any claims regarding defects, non-conformities, shortages, or damages to received goods must be submitted in writing within 7 (seven) working days from the delivery date, via email to: docmerchandising@audes.com
7.2 Reporting Procedure
Each claim must include:
- Order number or delivery note (DDT)
- Detailed description of the issue
- Supporting photos (mandatory in case of visible damages or defects)
- Claims lacking adequate documentation may be rejected.
7.3 Authorized Returns
Returns are accepted only with prior written authorization from the seller.
Goods must be returned intact, unused, and in their original packaging. Unauthorized returns will be refused and sent back to the sender.
7.4 Customized or Made-to-Order Items
Returns are not accepted for customized, made-to-measure, or special-order products unless proven defective or if an error is attributable to the seller.
7.5 Return Costs
Unless otherwise agreed, return shipping costs are borne by the customer. In case of seller error, a return label will be provided or pickup will be arranged at the seller’s expense.
7.6 Inspection and Credit Notes
Returned goods will be inspected upon arrival. If non-conformity is confirmed, a credit note will be issued or the product will be replaced, as agreed.
Liability
The seller is not liable for delays or failed deliveries due to force majeure or events beyond its control.Changes to the Terms
The seller reserves the right to modify these Terms and Conditions at any time. Changes will be communicated via the portal and will be effective from the date of publication.Jurisdiction
Any disputes shall fall under the exclusive jurisdiction of the Court of Padua (Italy)
